By downloading, installing, or using the Pebby mobile application or website, you agree to be bound by these Terms of Service. Please read them carefully. They set out the agreement between you and CREATIVE VLU SOLUTIONS SRL.
01 Acceptance of terms
By downloading, installing, or using the Pebby mobile application or website (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use Pebby.
The Service is operated by CREATIVE VLU SOLUTIONS SRL, a company incorporated under Romanian law (“Pebby”, “we”, “us”, or “our”).
You must be at least 18 years old to use Pebby. By using the Service, you confirm that you are 18 or older.
02 Description of service
Pebby is a shared-care baby tracking application that helps multiple caregivers coordinate baby care activities (including feeding, sleep, and diaper tracking) through real-time synchronisation and automated handover summaries.
Not medical advice. Pebby is a coordination and tracking tool only. Nothing in the Service constitutes medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional for guidance about your baby's health and development.
03 Account registration
To use Pebby, you must create an account by providing accurate and complete information, including your name and email address. You are responsible for:
- Keeping your login credentials confidential
- All activity that occurs under your account
- Notifying us immediately at contact@pebby.app if you suspect unauthorised access
You may only hold one account. We reserve the right to refuse registration or cancel accounts at our discretion.
04 Subscription and payment
Pebby is available through a paid subscription only. There is no free tier. Access to the Service requires an active, paid subscription.
Billing
Subscriptions are billed on a recurring basis (monthly or annual, as selected). Payment is processed via the applicable app store and/or Stripe, with subscription management handled by Adapty. By subscribing, you authorise us (or the app store) to charge your payment method on a recurring basis until you cancel.
Auto-renewal
Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You will receive a reminder before renewal where required by applicable law.
Cancellation
You may cancel your subscription at any time through the App Store (iOS) or Google Play Store (Android) settings. Cancellation takes effect at the end of the current billing period; you will retain access until then.
Refunds
Refund eligibility for purchases made through an app store is governed by that store's refund policy (Apple App Store or Google Play). We do not process refunds directly for purchases made through app stores. For billing issues not involving an app store, contact us at contact@pebby.app. This is without prejudice to your statutory rights, including the EU right of withdrawal described below.
Price changes
We may change subscription prices from time to time. We will give you at least 30 days' notice of any price change by email or in-app notification. If you do not cancel before the price change takes effect, your continued subscription constitutes acceptance of the new price.
05 EU/EEA right of withdrawal (consumers)
If you are a consumer in the EU/EEA, you normally have the right to withdraw from a distance contract within 14 days without giving any reason, under the EU Consumer Rights Directive.
Immediate access. Because Pebby provides immediate access to digital services upon subscription, by subscribing you expressly request that we begin providing the Service immediately and you acknowledge that you lose your 14-day right of withdrawal once the Service has been fully performed, and that for partial performance you may owe an amount proportionate to the service used. To exercise the right of withdrawal where it applies, contact contact@pebby.app before access begins.
06 Shared-care groups
Pebby allows you to invite other adults to join a shared caregiving group so they can view and contribute to tracking logs in real time.
- You are responsible for ensuring that everyone you invite has consented to their data being shared within the group.
- You represent and warrant that you have the authority and permission of each person you invite to add them to the group and to share the baby's tracking data with them.
- Only invite people you know and trust. Group members can see all tracking data and your display name.
- You can remove any caregiver from your group at any time from within the app, immediately revoking their access.
- The group owner (the person who created the profile) controls group membership.
07 Acceptable use
You agree not to:
- Use Pebby for any unlawful purpose or in violation of any applicable laws or regulations
- Enter false, misleading, or fraudulent data
- Share your account credentials with others (each caregiver must use their own account)
- Attempt to reverse engineer, decompile, disassemble, or otherwise derive the source code of Pebby
- Resell, sublicense, or otherwise commercialise access to the Service
- Introduce malware, viruses, or any code that could harm the Service or its users
- Scrape, crawl, or systematically access the Service using automated means without our prior written consent
- Harass, abuse, or harm any other user of Pebby
08 Your data
You retain ownership of the baby tracking data you enter into Pebby. By using the Service, you grant CREATIVE VLU SOLUTIONS SRL a limited, non-exclusive, worldwide licence to store, process, and display your data solely for the purpose of providing the Service to you and your caregiving group.
We do not sell your data to third parties. For full details of how we handle your personal data, see our Privacy Policy.
Backups. While we take reasonable measures to protect and retain your data, we are not obligated to maintain backups for you, and you are responsible for keeping your own records of any data that is important to you. We are not liable for any loss or corruption of data except as required by applicable law.
09 Feedback
If you send us feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free licence to use them without restriction or compensation. We are free to use such feedback to improve or develop the Service.
10 Intellectual property
All rights in the Pebby application, website, brand, trademarks, logos, and content (excluding your tracking data) are owned by or licensed to CREATIVE VLU SOLUTIONS SRL. Nothing in these Terms grants you any rights in Pebby's intellectual property other than the limited right to use the Service as described here.
If you believe content in the Service infringes your intellectual property rights, contact us at contact@pebby.app and we will address the notice in accordance with applicable law (including the EU Digital Services Act notice-and-action requirements).
11 App store terms
Apple App Store
If you download Pebby from the Apple App Store, the following additional terms apply, and you acknowledge that:
- These Terms are between you and CREATIVE VLU SOLUTIONS SRL only, not with Apple. Apple is not responsible for the Service or its content.
- Apple has no obligation to provide any maintenance or support for the Service; we are solely responsible for support, to the extent required by these Terms.
- Your licence to use the app is a non-transferable licence to use it on any Apple-branded device you own or control, as permitted by the Apple Media Services / App Store Usage Rules.
- In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation, and any other claims are our responsibility.
- We (not Apple) are responsible for addressing any claims relating to the app, including product-liability, legal/regulatory-compliance, and consumer-protection claims, and any third-party claim that the app infringes intellectual property rights.
- You represent that you are not located in a country subject to a US Government embargo or designated as “terrorist-supporting”, and that you are not on any US Government restricted-parties list.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
- You must comply with applicable third-party terms when using the app.
Google Play
If you download Pebby from Google Play, you acknowledge that these Terms are between you and us, not with Google, that Google is not responsible for the Service, and that your use is also subject to the Google Play Terms of Service. Billing for purchases made through Google Play is handled by Google under its terms.
12 Service availability
We aim to keep Pebby available 24/7, but we do not guarantee uninterrupted access. We may suspend or limit the Service for maintenance, security updates, or reasons outside our control. We are not liable for any loss resulting from temporary unavailability.
We reserve the right to modify, discontinue, or change features of the Service at any time. For material changes that affect core functionality, we will provide reasonable notice.
13 Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the Service will be error-free, uninterrupted, secure, or that any defects will be corrected. Your use of Pebby is at your own risk. Nothing in this section affects the statutory rights of consumers that cannot be excluded under applicable law.
14 Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless CREATIVE VLU SOLUTIONS SRL, its directors, employees, and agents from and against any claims, damages, losses, liabilities, and reasonable expenses (including legal fees) arising out of or related to: (a) your breach of these Terms; (b) your misuse of the Service; (c) your violation of any law or the rights of a third party, including any caregiver you invite; or (d) data you enter or share through the Service. This does not apply to the extent a claim arises from our own breach or negligence, and it does not limit consumer rights that cannot be waived under applicable law.
15 Limitation of liability
To the fullest extent permitted by applicable law, CREATIVE VLU SOLUTIONS SRL, its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, or loss of goodwill, arising from or related to your use of (or inability to use) the Service.
In any case, our total liability to you for any claim arising out of or related to these Terms or the Service shall not exceed the total subscription fees you paid to us in the 12 months preceding the claim.
Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
16 Termination
You may stop using Pebby and cancel your subscription at any time.
We may suspend or terminate your account immediately if we determine that you have violated these Terms, engaged in fraudulent activity, or pose a risk to the security of the Service or other users. Where reasonably possible, we will notify you before taking such action.
Upon termination, your right to access the Service ceases. We will handle your data after termination as described in our Privacy Policy (including deletion within 30 days, subject to legal retention requirements). The following provisions survive termination: Your Data, Feedback, Intellectual Property, Disclaimers, Indemnification, Limitation of Liability, Governing Law, and any other provision that by its nature should survive.
17 Governing law and disputes
These Terms are governed by and construed in accordance with the laws of Romania, without regard to its conflict of law provisions.
Any dispute arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Bucharest, Romania.
If you are an EU consumer, you may also be entitled to bring proceedings in the courts of your country of residence under applicable EU consumer protection law, and mandatory consumer-protection provisions of your home country continue to apply.
Online dispute resolution. EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr. In Romania, you may also contact the National Authority for Consumer Protection (ANPC).
18 General
Severability. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
Entire agreement. These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements.
No waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms (for example, in connection with a merger, acquisition, or sale of assets) without restriction.
Force majeure. We are not liable for any failure or delay in performing our obligations where the failure or delay results from events beyond our reasonable control, including outages of third-party cloud providers, internet failures, acts of government, or natural events.
Notices. We may provide notices to you by email (to the address associated with your account) or by in-app notice, and such notices are deemed received when sent. Notices to us should be sent to contact@pebby.app. You agree that electronic communications satisfy any legal requirement that communications be in writing.
19 Changes to these terms
We may update these Terms from time to time. For material changes, we will notify you at least 30 days in advance by email or via an in-app notice. The “Effective date” at the top of this page reflects the most recent version.
Your continued use of Pebby after the effective date of the updated Terms constitutes your acceptance of the new Terms.
